Terms of Service

1. Introduction

Welcome to Mind Brain Institute, Delhi (“we,” “us,” or “Clinic”). By
accessing or using our services (in-person therapy, teleconsultations, online bookings, digital patient portal, website or mobile apps) you (“Patient”, “Client”, “User”) agree to these Terms of Service (the “ToS”). These ToS form a binding agreement between you and the Clinic.

2. Eligibility

1) You must be 18 years or older and legally capable of entering binding contracts to use our services. If you are under 18 or have limited legal capacity, services must be accessed with the consent and assistance of a parent/guardian.
2) Where an individual is diagnosed with a mental illness that impairs their capacity to make informed decisions, consent may be provided by their Nominated Representative in accordance with the Mental Healthcare Act, 2017.

3. Services

Our services include psychiatric evaluation, psychological counselling, therapy sessions, telemental health, assessments, and related care (“Services”). We may update services periodically.
(a) Tele-consultation Consent
The User voluntarily consents to avail tele-mental health services and understands the limitations of remote consultation, including the absence of physical examination as per Telemedicine Practice Guidelines, 2020.
(b) Not Emergency Service
The services provided by the Clinic do not constitute emergency medical services. In case of crisis, suicidal thoughts, or immediate danger, the User must contact emergency services or visit the nearest hospital.
(c) Prescription Discretion
Prescription of medicines shall remain at the sole professional discretion of the consulting doctor in accordance with applicable medical guidelines.

4. Appointment and Fees

All appointments are subject to availability. Fees, cancellation, rescheduling, or refund terms will be communicated at the time of booking. You agree to pay all applicable charges and follow the instructions provided by Clinic staff.

5. Clinical Records and Consent

You acknowledge that accurate information is necessary for proper care. In cases where decision-making capacity is impaired, consent may be obtained from a duly authorised representative as permitted under applicable mental health laws. Confidentiality of mental health records shall be maintained in accordance with the Mental Healthcare Act, 2017. Information may be disclosed without consent only when required by law, court order, to a nominated representative, or in situations of serious and imminent risk to the patient or others.

6. User Obligations

You must provide accurate contact details, medical history, and other information necessary for care. You must abide by the Clinic rules, professional conduct, and ethics during sessions. The patient agrees to provide a complete and accurate medical history and information. The Clinic shall not be responsible for consequences arising from incomplete or incorrect disclosure. The User shall not record audio/video of sessions without prior written permission of the Clinic

7. Intellectual Property

All content on our website, portal, and app (text, logos, images, clinical content) is owned by the Clinic and protected under applicable intellectual property laws.

8. Third-Party Links and Referrals

We may link to third-party websites and tools. We are not responsible for their terms, privacy policies, or practices. Referrals to other healthcare providers occur only with your consent.

Communication platforms such as WhatsApp, SMS gateways, or video consultation tools are third-party services,
and the Clinic shall not be liable for delays, downtime, or technical failures attributable to such platforms

9. Disclaimer of Warranties

Services are provided “as is” without warranties of any kind. Mind Brain Institute does not guarantee specific clinical outcomes.
Nothing in these Terms excludes liability for professional negligence where established under applicable law; however, treatment outcomes vary and depend upon patient compliance, clinical variables, and external factors beyond the control of the Clinic.

10. Limitation of Liability

To the fullest extent permitted by law, the Clinic is not liable for indirect, incidental, or consequential damages arising from your use of our services.

11. Termination

We may suspend or terminate access for violation of these ToS or if required by law.

12. Governing Law & Dispute Resolution

These ToS are governed by the laws of India. Disputes will be referred to courts in Delhi.

13. Amendments

We may update these ToS at any time and will notify you of major changes through our website or direct communication.
